HB 45: Blair Holt's Firearm Licensing and Record of Sale Act of 2009
"To provide for the implementation of a system of licensing for purchasers of certain firearms and for a record of sale system for those firearms, and for other purposes."
This bill is a disastrous bill and will cut deep into the rights of law-abiding gun owners. It should be opposed by all defenders of the Constitution. As of the time of the posting of this newsletter HB 45 is in committee. The bill was introduced on January 6, 2009.
H.R. 45 was introduced by representative Bobby Rush (D-IL) and if passed, would require all handguns and semiautomatic firearms, including the ones gun owners already own to be licensed. A thumb print would be required and the gun owner would have to sign a certificate stating that the firearm would not be kept in a location where it's easily accessible. That very idea precludes the gun owner's ability to defend his or her family and property.
The applicant will also be required to submit medical records to authorities, pass an exam, and pay a $25.00 fee. The "license" would have to be renewed every five years and would be subject to being rescinded at any time. The private sale of firearms would be outlawed. All firearms transactions would be subject to the Brady check. H.R. 45 would make virtually any loaded gun an illegal gun and there would be stiff penalties for such an offense. "Crimes by omission" are included in the bill as well. The penalties would include up to ten years in prison and possible fines. Also included is a broad inspection and regulatory authority.
The bottom line is that this is bad for gun owners and citizens, violates our constitutional right to own guns, and certainly sounds like one more move towards a socialistic form of government. H.R. 45 is an "open invitation" to criminals.
